1. Introduction
This website and online store (the "Store"), available at [your store domain, e.g. www.yourstore.com], is operated by Jiyash Designs LLP, a limited liability partnership registered in India, having its registered office at 1st & 2nd Floor, B-33/132, Siddha CHS Ltd, Marg Number 2, opp. Vivek College Road, Siddharth Nagar, Goregaon West, Mumbai, Maharashtra 400104, ("Jiyash Designs", "we", "us" or "our"). By visiting the Store, creating an account or placing an order, you ("you" or "the customer") agree to these Terms of Service ("Terms"), together with our Privacy Policy and Shipping & Refund Policies. If you do not agree, please do not use the Store.
These Terms are an electronic record under the Information Technology Act, 2000 and do not require physical or digital signatures.
2. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place orders. If you are under 18, you may use the Store only with the involvement and consent of a parent or legal guardian.
3. Your Account
If you create an account, you must provide accurate and complete information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at [email] if you suspect unauthorised use. We may suspend or close accounts that contain false information or are used in breach of these Terms.
4. Products and Descriptions
We make reasonable efforts to describe and display our products accurately, including colours, dimensions, materials and finishes. Because screens differ and many items are made or finished by hand, minor variations in colour, texture or size may occur and are not defects. Product availability is subject to change without notice, and we may limit quantities or discontinue products at any time.
5. Pricing and Taxes
All prices are displayed in Indian Rupees (INR) unless stated otherwise and, unless stated otherwise, include applicable GST. Shipping charges, if any, are shown at checkout before you pay. We may change prices at any time, but changes will not affect orders already confirmed. If we discover a pricing error on an item you ordered, we may cancel the order and refund any amount paid, or contact you to confirm the correct price.
6. Orders and Acceptance
Placing an order is an offer to buy. An order is accepted only when we send you an order confirmation or dispatch the goods. We may refuse or cancel an order, in whole or in part, for reasons including stock unavailability, pricing or description errors, suspected fraud, or inability to deliver to your address. If we cancel an order you have already paid for, we will refund the full amount.
7. Payments
Payments are processed through third-party payment gateways and methods made available at checkout (such as UPI, cards, net banking, wallets and, where offered, Cash on Delivery). We do not store your full card or banking details. You confirm that you are authorised to use the payment method you choose. Orders may be held or cancelled if payment is not successfully completed or is reversed.
8. Shipping and Delivery
We ship to the serviceable pincodes shown at checkout through third-party courier partners. Estimated delivery timelines are indicative and not guaranteed; delays caused by couriers, weather, strikes, incorrect addresses or other events beyond our control are not our liability. Risk of loss passes to you on delivery. Please inspect the parcel on receipt and report visible damage within [48 hours] of delivery. Our detailed Shipping Policy forms part of these Terms.
9. Returns, Replacements and Refunds
Returns, replacements and refunds are governed by our Refund & Return Policy, which forms part of these Terms. In summary, [state your policy, e.g. eligible items may be returned within 7 days of delivery if unused, in original packaging and with proof of purchase; custom, personalised or made-to-order items are non-returnable unless received damaged or defective]. 10. Custom and Made-to-Order Work
Where we create products to your specifications, you are responsible for the accuracy of any text, measurements, images or files you supply. Production begins once the order is confirmed, and custom orders generally cannot be cancelled or changed after production has started. You confirm that any content you submit does not infringe anyone else's rights.
11. Intellectual Property
All content on the Store, including designs, artwork, product images, logos, text, graphics and layouts, is owned by or licensed to Jiyash Designs LLP and is protected by Indian and international intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, modify, distribute, sell or use our content or designs for commercial purposes without our prior written permission. Purchasing a product does not transfer any intellectual property rights in the underlying design.
12. Acceptable Use
You agree not to: use the Store for any unlawful purpose; attempt to gain unauthorised access to our systems or other users' accounts; introduce viruses or harmful code; use bots, scrapers or automated tools without our permission; submit false or misleading information; or interfere with the proper working of the Store.
13. User Content and Reviews
If you post reviews, comments or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You confirm that the content is your own, is truthful, and is not unlawful, defamatory or infringing. We may remove content at our discretion.
14. Third-Party Links and Services
The Store may link to or rely on third-party services (including Shopify, payment gateways and couriers). We are not responsible for their content, availability or practices, and your use of them is subject to their own terms.
15. Disclaimer of Warranties
Except as expressly stated in these Terms or required by law, the Store and all products are provided on an "as is" and "as available" basis. We do not guarantee that the Store will be uninterrupted, secure or error-free.
16. Limitation of Liability
To the fullest extent permitted by law, Jiyash Designs LLP, its partners, employees and agents will not be liable for any indirect, incidental, special or consequential loss arising from your use of the Store or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory rights as a consumer.
17. Indemnity
You agree to indemnify and hold harmless Jiyash Designs LLP and its partners and employees from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Store.
18. Force Majeure
We are not liable for failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, government action, strikes, transport disruptions, power or internet failures.
19. Termination
We may suspend or terminate your access to the Store at any time if you breach these Terms. Provisions that by their nature should survive termination (including intellectual property, liability and governing law) will continue to apply.
20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and applies to orders placed after that date.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to any rights you have under consumer protection law to approach a consumer commission at your place of residence, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising from these Terms.
